Bad debtor’s registers are lists of people that have defaulted on debt payments.

Banks, telephone, electricity water, gas, etc. companies, register anyone who fails to pay a bill or who is behind with payment. The defaults are processed automatically, with no consideration given to the amount or the reason for non-payment.

These lists are used by many banking institutions when approving loans of mortgages, and therefore if you are listed on one it will stop you accessing the requested finance.

What problems will being on a list cause me?

Some companies use lists of defaulters to frighten and put pressure on users who leave their companies, and do not wish to pay for what they consider to be poor or abusive service (for example minimum contract term penalties, prices not as agreed, etc.)

There is no minimum amount for inclusion on a list of defaulters.

How long can my information remain in a record of defaults?

Your information will remain in the records forever unless you take the necessary steps to have it removed. The maximum period your information can be included on a List of Defaulters is 6 years. However the Lists of Defaulters never let that period run and conduct periodic modifications to ensure that they never expire.

Why am I still included as a defaulter if I have paid off the debt?

Although you have settled the debt, the information held about you in records of defaults will remain there forever, unless you cancel it.

Why am I listed as a defaulter when nobody has warned me in advance?

The person is not notified in advance of being added to a List of Defaulters, debtors are automatically included in records without being consulted or notified.

Why am I listed as a defaulter if the debt is not mine?

How many bad debtor's registers are there?

The bad debtor’s databases that exist in Spain are:

ASNEF, RAI, EQUIFAX, EXPERIAN, BADEXCUG, INFODEUDA e INFORMA. There is also a special database for real estate companies FIM.

What is ASNEF?

ASNEF, Spanish National Association of Financial Credit Institutions, is a register that certain institutions register their customers with when they default. If you fail to pay your electricity, telephone bill or loan you can easily find yourself registered amongst the names already contained therein. Each month 200,000 people are added to the register.

The telecommunications companies usually register with ASNEF customers returning at least three unpaid bills.

What is RAI?

RAI, is the Register of Unpaid Accepted Documents, a list of defaulters that registers legal persons, with defaults equal to or greater than €300.51. These are reflected in documents, which include the signature of the legal person recognising the debt, such as: promissory notes, cheques, letters of credit, etc.

What is Equifax?

EQUIFAX is a list of defaulters used by financial institutions when making business decisions, and by companies in other sectors, notable amongst which are telecommunications companies, financial institutions, utilities (electricity, water, gas), publishers, insurers or any other institution associated with the register. ASNEF associate and member companies can register you with these lists, which cover all of the specialist credit institutions, such as banks, building societies, financial institutions, etc.

What is Experian?

EXPERIAN BUREAU DE CREDITO is a list of defaulters used by institutions to study credit risk, and fraud.

It includes information regarding compliance or non-compliance with financial obligations. This information can be provided to the creditor or those acting in its name or interest. Consent is not required for inclusion.

What is Badexcug?

BADEXCUG, list of defaulters, contains information on natural and legal persons, provided by creditors, due to their customers failing to comply with financial obligations. Institutions such as: Banks, Building Societies, Financial Credit Institutions, Credit Cooperatives and Telecommunications Operators included in the Register of Operators held by the Spanish Telecommunication Market Commission may include us. What is Informa?

INFORMA is a company that provides commercial, financial and marketing information. It is used to find out about potential customers and suppliers and minimise commercial risk. What is CIRBE?

CIRBE, Risk Information Centre of the Central Bank of Spain. Not a list of defaults per se, but a register held by the Bank of Spain, including credits, discount lines, loans, guarantees and other risks managed by financial institutions. This register is used by financial institutions when granting any type of financing.

What is FIJ?

FIJ, the Spanish register of judicial incidents is a list of defaulters containing information for public access, such as: Official or Court gazettes, which include debts with the Spanish General Social Security Treasury, Traffic, Treasury, Councils, and other of an official nature.
